5“If a man causes a field or vineyard to be grazed bare or lets his livestock loose so that it grazes in another man’s field, he shall make restitution from the best of his own field and the best of his own vineyard. 6“If fire breaks out and spreads to thorn bushes so that the stacked grain or standing grain or the field is consumed, he who started the fire shall make full restitution. “If a man gives his neighbor money or [other] goods to keep [for him while he is away] and it is stolen from the neighbor’s house, then, if the thief is caught, he shall pay double [for it]. 8If the thief is not caught, the owner of the house shall appear before the judges [who act in God’s name], to determine whether or not he had stolen his neighbor’s goods. 9For every offense involving property, whether it concerns ox, donkey, sheep, clothing, or any piece of lost property, which another identifies as his, the case of both parties shall come before the judges [who act in God’s name]. Commentaries on Exodus 22:7
- Adam Clarke Bible Commentary · v. 7Deliver unto his neighbor - This is called pledging in the law of bailments; it is a deposit of goods by a debtor to his creditor, to be kept till the debt be discharged. Whatever goods were thus left in the hands of another person, that person, according to the Mosaic law, became responsible for them; if they were stolen, and the thief was found, he was to pay double; if he could not be found, the oath of the person who had them in keeping, made before…Read the comment
- Tyndale Open Study Notes · v. 1-15In cases involving loss of property, the responsible person had to pay compensation equal to the value of what was lost. If the person had actually stolen the property, the compensation was multiplied (22:1, 4, 7). Where there was a question of responsibility, the parties were to appear before God for adjudication (22:8). The means by which the judgment was reached is not reported.Read the comment
- Jamieson–Fausset–Brown Commentary · v. 1-311-4. If a man shall steal an ox, or a sheep--The law respects the theft of cattle which constituted the chief part of their property. The penalty for the theft of a sheep which was slain or sold, was fourfold; for an ox fivefold, because of its greater utility in labor; but, should the stolen animal have been recovered alive, a double compensation was all that was required, because it was presumable he (the thief) was not a practised adept in dishonesty…Read the comment
