Context of Exodus 22:10
8if the thief be not found, the master of the house shall be brought before the judges, [to see] if he has not put his hand unto his neighbour's goods. 9As to all manner of fraud, — as to ox, as to ass, as to sheep, as to clothing, as to everything lost, of which [a man] saith, It is this — the cause of both parties shall come before the judges: he whom the judges shall condemn shall restore double to his neighbour. If a man deliver unto his neighbour an ass, or an ox, or a sheep, or any cattle, to keep, and it die, or be hurt, or driven away, and no man see [it], 11an oath of Jehovah shall be between them both, that he hath not put his hand unto his neighbour's goods; and the owner of it shall accept it, and he shall not make [it] good. 12But if it have been stolen from him, he shall make [it] good unto its owner.

Commentaries on Exodus 22:10
- Barnes’ Notes on the Bible · v. 10-13Verses 10-13 This law appears to relate chiefly to herdsmen employed by the owners of cattle. When an animal was stolen Exodus 22:12, it was presumed either that the herdsman might have prevented it, or that he could find the thief and bring him to justice (see Exodus 22:4). When an animal was killed by a wild beast, the keeper had to produce the mangled carcass, not only in proof of the fact, but to show that he had, by his vigilance and courage…Read the comment
- Tyndale Open Study Notes · v. 1-15In cases involving loss of property, the responsible person had to pay compensation equal to the value of what was lost. If the person had actually stolen the property, the compensation was multiplied (22:1, 4, 7). Where there was a question of responsibility, the parties were to appear before God for adjudication (22:8). The means by which the judgment was reached is not reported.Read the comment
- Jamieson–Fausset–Brown Commentary · v. 1-311-4. If a man shall steal an ox, or a sheep--The law respects the theft of cattle which constituted the chief part of their property. The penalty for the theft of a sheep which was slain or sold, was fourfold; for an ox fivefold, because of its greater utility in labor; but, should the stolen animal have been recovered alive, a double compensation was all that was required, because it was presumable he (the thief) was not a practised adept in dishonesty…Read the comment
