Context of Exodus 21:22
20If a man strikes his manservant or maidservant with a rod, and the servant dies by his hand, he shall surely be punished. 21However, if the servant gets up after a day or two, the owner shall not be punished, since the servant is his property. If men who are fighting strike a pregnant woman and her child is born prematurely, but there is no further injury, he shall surely be fined as the woman’s husband demands and as the court allows. 23But if a serious injury results, then you must require a life for a life— 24eye for eye, tooth for tooth, hand for hand, foot for foot,

- Adam Clarke Bible Commentary · v. 22And hurt a woman with child - As a posterity among the Jews was among the peculiar promises of their covenant, and as every man had some reason to think that the Messiah should spring from his family, therefore any injury done to a woman with child, by which the fruit of her womb might be destroyed, was considered a very heavy offense; and as the crime was committed principally against the husband, the degree of punishment was left to his discretion. But…Read the comment
- Barnes’ Notes on the Bible · v. 22-25Verses 22-25 The rule would seem to refer to a case in which the wife of a man interfered in a quarrel. This law, “the jus talionis,” is elsewhere repeated in substance, compare the marginal references. and Genesis 9:6. It has its root in a simple conception of justice, and is found in the laws of many ancient nations. It serves in this place as a maxim for the magistrate in awarding the amount of compensation to be paid for the infliction of personal…Read the comment

If we have done wrong, we must be very willing to make it good, and be desirous that nobody may lose by us.Read the comment
- Tyndale Open Study Notes · v. 22-25her child is born prematurely: It appears that if a child’s birth was caused prematurely and the child died (that is, there was further injury), the penalty for murder was to be enacted. The law of retaliation (the lex talionis) called for a penalty that matched the injury inflicted on a victim. But this law also served to limit the punishment so it was not more severe than the original injury. Compare Matthew 5:38–39.Read the comment
- Jamieson–Fausset–Brown Commentary · v. 7-367-11. if a man sell his daughter--Hebrew girls might be redeemed for a reasonable sum. But in the event of her parents or friends being unable to pay the redemption money, her owner was not at liberty to sell her elsewhere. Should she have been betrothed to him or his son, and either change their minds, a maintenance must be provided for her suitable to her condition as his intended wife, or her freedom instantly granted.Read the comment
