Context of Deuteronomy 25:5
3He may have him beaten forty times, but no more. He is not to be beaten with more stripes than these and he is not to be degraded [that is, treated like an animal] in your sight. 4“You shall not muzzle the ox while he is threshing [to prevent him from eating any of the grain]. “If brothers are living together and one of them dies without a son, the widow of the deceased shall not be married outside the family to a stranger. Her husband’s brother shall be intimate with her after taking her as his wife and perform the duty of a husband’s brother to her. 6It shall be that her firstborn [son] will be given the name of the dead brother, so that his name will not be blotted out of Israel. 7But if the man does not want to marry his brother’s [widowed] wife, then she shall go up to the gate [of the city, where court is held] to the elders, and say, ‘My brother-in-law refuses to continue his brother’s name in Israel; he is not willing to perform the duty of a husband’s brother.’

- Barnes’ Notes on the Bible · v. 5-10Verses 5-10 The law of levirate marriage. The law on this subject is not unique to the Jews, but is found (see Genesis 38:8) in all essential respects the same among various Oriental nations, ancient and modern. The rules in these verses, like those upon divorce, do but incorporate existing immemorial usages, and introduce various wise and politic limitations and mitigations of them. The root of the obligation here imposed upon the brother of the deceased…Read the comment

- Tyndale Open Study Notes · v. 5The phrase fulfill the duty of a brother-in-law refers to the levirate marriage custom. The word levirate comes from a Latin word meaning “brother-in-law.” When a married man died without a son, his brother was encouraged to marry the widow. He would father children in his brother’s name so that the dead man’s family line would continue. For examples of this custom, see Genesis 38:6–11; Ruth 3:12–13; 4:1–12; Luke 20:27–33.Read the comment
- Jamieson–Fausset–Brown Commentary · v. 5-105-10. the wife of the dead shall not marry without unto a stranger: her husband's brother ... shall take her to him to wife--This usage existed before the age of Moses (Ge 38:8). But the Mosaic law rendered the custom obligatory (Mt 22:25) on younger brothers, or the nearest kinsman, to marry the widow (Ru 4:4), by associating the natural desire of perpetuating a brother's name with the preservation of property in the Hebrew families and tribes.
